1. Introduction and General Terms

My Valid Emails (MVE) is committed to protecting you and your family's personal information when you are using MVE services. We want our services to be safe and enjoyable environments for all our user. This Privacy Policy relates to our use of any personal information you provide to us through myvalidemails.com websites.

In order to provide you with the full range of MVE services, we are sometimes required to collect information about you.

This privacy policy explains the following:

• what information MVE may collect about you;
• how MVE will use information we collect about you;
• when MVE may use your details to contact you;
• whether MVE will disclose your details to anyone else;
• your choices regarding the personal information you have provided to us;
• the use of cookies on MVE website and how you can reject these cookies.

As set out above, MVE is committed to safeguarding your personal information. Whenever you provide such information, we are legally obliged to use your information in line with all laws concerning the protection of personal information, including the Data Protection Act 1998 (these laws are referred to collectively in this Privacy Policy as the "data protection laws").

The website contains hyperlinks to websites owned and operated by third parties. These third party websites have their own privacy policies, including cookies, and we urge you to review them. They will govern the use of personal information you submit or are collected by cookies whilst visiting these websites. We do not accept any responsibility or liability for the privacy practices of such third party websites and your use of such websites is at your own risk.

2. What information will MVE collect about me?

When you sign up to participate in or receive a service from myvalidemails.com website, such as newsletters, competitions, live chats, message boards or register with the single universal online registration system used across different parts of myvalidemails.com called "Single Sign-On", we may ask for personal information about you. This can consist of information such as your name, e mail address, postal address, telephone or mobile number or date of birth. Different webpages may ask for different personal information.

By entering your details in the fields requested, you enable MVE and its service providers to provide you with the services you select.

Please note that sometimes on particular webpages we will require you to provide additional personal information, and sometimes sensitive personal information (e.g. if you're sending in an application to be a contributor on a political party we may need to know your political leanings). When we do this we will specify further on these webpages why we are collecting your information and how we will use it.

MVE also uses cookies (see paragraph 13 below for details) and collects IP addresses (an IP address is a number that can uniquely identify a specific computer or other network device on the internet). We use analysis software to look at IP addresses and cookies for the purpose of enhancing your user experience. This information is not used to develop a personal profile of you and the log files are regularly purged.

We also use your IP address to determine whether you are accessing the services from the UK or not. If not, you will be re-directed to the international version of myvalidemails.com site (see paragraph 11 for details.)

3. How will MVE use the information they collect about me?

MVE will use your personal information for a number of purposes including the following:

• for "service administration purposes", which means that MVE may contact you for reasons related to the service you have signed up for, as set out in paragraph 4 below (e.g. to provide you with password reminders or to notify you that a particular service has been suspended for maintenance);
• to contact you about a submission you have made to the websites, including any content you provide, see especially the UGC FAQS.
• to personalise the way MVE content is presented to you (e.g. if we notice that the first thing you look at every day is the weather for Luton, then we may present this information or a link to it on your homepage);
• IP addresses are used to identify the location of users, the number of visits from different countries and also to block disruptive use; and
• to analyse and improve the services offered on myvalidemails.com. e.g. to provide you with the most user-friendly navigation experience.

Where MVE proposes using your personal information for any other uses we will ensure that we notify you first. You will also be given the opportunity to withhold or withdraw your consent for your use other than as listed above.

4. When will MVE contact me?

MVE may contact you:

• in relation to the functioning of any service you have signed up for in order to ensure that MVE can deliver the services to you;
• where you have opted to receive further correspondence;
• in relation to any contribution you have made to myvalidemails.com, e.g. on MVE message boards;
• to invite you to participate in surveys about MVE services (participation is always voluntary); and
• for marketing purposes where you have specifically agreed to this (see paragraph 5 below)

Local pages will give you detailed information about how MVE will contact you in relation to specific services.

5. Will I be contacted for marketing purposes?

MVE won't contact you for marketing purposes, or promote new services to you unless you specifically agree to be contacted for these purposes.

6. Will MVE share my personal information with anyone else?

We will keep your information confidential except where disclosure is required or permitted by law (for example to government bodies and law enforcement agencies) or as described in paragraph 7 below. Generally, we will only use your information within MVE. However, sometimes MVE uses third parties to process your information. MVE will require these third parties to comply strictly with its instructions and MVE will require that they do not use your personal information for their own business purposes.

Please note that if you are accessing MVE from outside the UK and you make a comment or complaint regarding any element of advertising (see paragraph 11 for more details about this) then MVE may forward your correspondence to AMM only for the purposes of responding to you.

7. Offensive or inappropriate content on MVE website

If you post or send offensive, inappropriate or objectionable content anywhere on or to myvalidemails.com, or otherwise engage in any disruptive behaviour on myvalidemails.com, MVE may use your personal information to stop such behaviour.

Where MVE reasonably believes that you are or may be in breach of any of the laws of England or Wales (e.g. because content you have posted may be defamatory), MVE may use your personal information to inform relevant third parties such as your employer, school e-mail/Internet provider or law enforcement agencies about the content and your behaviour.

8. What if I am a user aged 16 or under?

If you are aged 16 or under, please get your parent/guardian's permission beforehand whenever you provide personal information to MVE's website. Users without this consent are not allowed to provide us with personal information.

9. How long will MVE keep my personal information?

We will hold your personal information on our systems for as long as is necessary for the relevant service, or as long as is set out in any relevant contract you hold with MVE or MVE's corporate retention schedule (this is a database that defines which documents should be kept and for how long). In the case that you wish to cancel your registration as a myvalidemails.com member, once an account is deleted a red flag goes on the database and, while people cannot use the personal information, it stays on the system for a period of one year for administration purposes before being deleted automatically.

Where you contribute to myvalidemails.com MVE will generally only keep your content for as long as is reasonably required for the purpose(s) for which it was submitted. For example, MVE will only keep copies of entries to a photographic competition for the duration of the competition. However other projects (e.g. the People's War website) are likely to have a longer, or even permanent, duration.

MVE, as a publicly funded organisation, also has an obligation to record snapshots of history which may include some User Generated Content i.e. content provided by users. Therefore, some content submitted to or shared with MVE may be retained for prolonged periods of time or potentially indefinitely in MVE's Archive, which is true of News contributions which are published. There may also be rare instances where we will share your contribution with third parties in the interests of maintaining historical archives (e.g. contributions about people's experiences in the World War II were given to the Imperial War Museum). Where possible, we will endeavour to inform you upfront or let you know at a later date where we are likely to keep content indefinitely or pass it onto an approved historical archive.

10. Can I find out what personal information MVE holds about me?

Under the Data Protection Act you have the right to request a copy of the personal information MVE holds about you and to have any inaccuracies corrected. (We charge £10 for information requests and will require you to prove your identity with 2 pieces of approved photographic identification.) We will use reasonable efforts to supply, correct or delete personal information about you on our files.

11. What if I am accessing MVE websites outside the UK?

www.myvalidemails.com is published in the UK by MVE. For international users accessing the site from outside the UK, the site is made available to you by MVE's commercial subsidiary, Acumen Multimedia Limited. ("AMM"), on a commercial basis (ie some of the pages you access will have advertising on them) under licence from MVE. However all personal information submitted by you to the site goes directly to MVE and will be processed in accordance with this Privacy Policy (and any local terms that apply on websites) unless terms on sites specify otherwise.

You should note that AMM does place a number of cookies on www.myvalidemails.com and may collect information about international users from these - please see paragraph 13 for more information about cookies.

13. Cookies Policy -Information MVE collects from you

a. What is a cookie?

A cookie is a small amount of data, which often includes a unique identifier that is sent to your computer or mobile phone (referred to here as a "device") browser from a website's computer and is stored on your device's hard drive. MVE and AMM use this type of information to help improve the services it provides to its users. MVE and AMM strictly require that third parties do not use any information for their own business or other purposes (see paragraph 6 above). About the terms

Access to and use of myvalidemails.com' both within the UK and internationally is provided by MVE (international users of the site may see some advertising on certain pages which is provided by MVE's commercial arm, Acumen Multimedia Limited ("AMM")) on the following terms:

1. By using myvalidemails.com you agree to be bound by these terms, which shall take effect immediately on your first use of myvalidemails.com. If you do not agree to be bound by all of the following terms please do not access, use and/or contribute to myvalidemails.com.

2. The MVE may change these terms from time to time and so you should check these terms regularly. Your continued use of myvalidemails.com will be deemed acceptance of the updated or amended terms. If you do not agree to the changes, you should cease using this website. If there is any conflict between these terms and specific local terms appearing elsewhere on myvalidemails.com (including house rules) then the latter shall prevail.

Use of myvalidemails.com

3. You agree to use myvalidemails.com only for lawful purposes, and in a way that does not infringe the rights of, restrict or inhibit anyone else's use and enjoyment of myvalidemails.com. Prohibited behaviour includes harassing or causing distress or inconvenience to any person, transmitting obscene or offensive content or disrupting the normal flow of dialogue within myvalidemails.com.

Intellectual Property

4. All copyright, trade marks, design rights, patents and other intellectual property rights (registered and unregistered) in and on myvalidemails.com and all content (including all applications) located on the site shall remain vested in MVE or its licensors (which includes other users). You also agree not to adapt, alter or create a derivative work from any myvalidemails.com content except for your own personal, non-commercial use. 5. The names, images and logos identifying MVE or third parties and their products and services are subject to copyright, design rights and trade marks of MVE, AMM and/or third parties. Nothing contained in these terms shall be construed as conferring any licence or right to use any trade mark, design right or copyright of MVE or any other third party.

Contributions to MVE

6. By sharing any contribution (including any text, photographs, graphics, video or audio) with MVE you agree to grant to MVE, free of charge, permission to use the material in any way it wants (including modifying and adapting it for operational and editorial reasons) for MVE services in any media worldwide (including on MVE's site accessed by international users). In certain circumstance MVE may also share your contribution with trusted third parties*.

7. Copyright in your contribution will remain with you and this permission is not exclusive, so you can continue to use the material in any way including allowing others to use it.

8. In order that MVE can use your contribution, you confirm that your contribution is your own original work, is not defamatory and does not infringe any UK laws, that you have the right to give MVE permission to use it for the purposes specified above, and that you have the consent of anyone who is identifiable in your contribution or the consent of their parent / guardian if they are under 16.

9. We normally show your name with your contribution, unless you request otherwise, but for operational reasons this is not always possible. The MVE may need to contact you for administrative or verification purposes in relation to your contribution, or in relation to particular projects. 10. Please do not endanger yourself or others, take any unnecessary risks or break any laws when creating content you may share with MVE.

11. If you do not want to grant MVE the permission set out above on these terms, please do not submit or share your contribution to or with myvalidemails.com.
*In the case of news-related material please note that this may be shared with MVE's overseas partners; these are all reputable foreign news broadcasters who are prohibited from altering the material in any way or providing it to other UK broadcasters or to the print media.

13. In order to participate in and contribute to selected myvalidemails.com communities you may be required to register with myvalidemails.com. Any personal information supplied to myvalidemails.com as part of this registration process and/or any other interaction with myvalidemails.com will be collected, stored and used in accordance with MVE Privacy Policy.

14. You agree to use myvalidemails.com communities (including message boards) in accordance with the following Community Rules. These apply across all myvalidemails.com community sites and services. You should, however, read the local house rules of the particular site or service you're using, as there may be some local variations to these Community Rules.

(i) About your posts:

• Contributions must be civil and tasteful.
• No disruptive, offensive or abusive behaviour: contributions must be constructive and polite, not mean-spirited or contributed with the intention of causing trouble.
• No unlawful or objectionable content: unlawful, harassing, defamatory, abusive, threatening, harmful, obscene, profane, sexually oriented, racially offensive or otherwise objectionable material is not acceptable.
• Be patient: users of all ages and abilities may be taking part in the relevant myvalidemails.com community.
• No spamming or off-topic material: we don't allow the submission of the same or very similar contributions many times. Please don't re-submit your contribution to more than one discussion, or contribute off-topic material in subject-specific areas.
• No advertising or promoting.

(ii) Your MVE Account:

If you use multiple logins for the purpose of disrupting a community or annoying other users you may have action taken against all of your accounts.

All accounts must be registered with a valid personal email address that you access regularly so that moderation emails can be sent to you. Accounts registered with someone else's email address, or with temporary email addresses may be closed without notice. We may require users to re-validate their account if we believe they have been using an invalid email address.

The MVE reserves the right to close accounts if any user is seen to be using proxy IPs (Internet Protocol addresses) in order to attempt to hide the use of multiple MVE accounts, or if an non UK user pretends to be a UK user, or disrupts any of our services in any way.

(iii) Safety:

We advise that you never reveal any personal information about yourself or anyone else (for example: telephone number, postal address, home address or email address or any other details that would allow you to be personally identified) in any MVE community.

(iv) Legal requirements:

• You may not submit or share any defamatory or illegal material of any nature in myvalidemails.com communities. This includes text, graphics, video, programs or audio.
• Contributing material to a myvalidemails.com community with the intention of committing or promoting an illegal act is strictly prohibited.
• You agree to submit to or share with myvalidemails.com communities only contributions which are your own original work. You must not violate, plagiarise, or infringe the rights of MVE or third parties including copyright, trade mark, trade secrets, privacy, publicity, personal or proprietary rights.

(v) If you're under 16:

• Please get a parent's or guardian's permission before taking part in any myvalidemails.com community.
• Never reveal any personal information about yourself or anyone else (for example, school, telephone number, your full name, home address or email address).

(vi) If you breach these Community Rules:

If you fail to abide by these Community Rules (and/or any variations in relevant local house rules) when taking part in a myvalidemails.com community, you will be sent an email which informs you why your contribution has been refused or edited. This email will also include a warning that continuing to break the rules may result in action being taken against your account or accounts.

This action may include any content posted by you being checked before allowed to go on the site or a temporary or permanent suspension of your ability to participate in any or all of myvalidemails.com community areas.

If you submit or share offensive or inappropriate content to or with any myvalidemails.com communities or anywhere else on myvalidemails.com or otherwise engage in any disruptive behaviour on myvalidemails.com, and MVE considers such behaviour to be serious and/or repeated, MVE may use whatever information that is available to it about you to stop any further such infringements. This may include informing relevant third parties such as your employer, school or email provider about the infringement(s).

The MVE reserves the right to delete any contribution, or take action against any MVE account, at any time, for any reason.

Disclaimers and Limitation of Liability

15. The majority of content posted in myvalidemails.com communities is created by members of the public. The views expressed are theirs and unless specifically stated are not those of MVE or AMM. Neither MVE nor AMM are responsible for any content posted by members of the public on myvalidemails.com or for the availability or content of any third party sites that are accessible through myvalidemails.com. Any links to third party websites from myvalidemails.com do not amount to any endorsement of that site by MVE or AMM and any use of that site by you is at your own risk.

16. myvalidemails.com content, including the information, names, images, pictures, logos and icons regarding or relating to MVE, its products and services (or to third party products and services), is provided "AS IS" and on an "AS AVAILABLE" basis. To the extent permitted by law, MVE excludes all representations and warranties (whether express or implied by law), including the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy. The MVE does not guarantee the timeliness, completeness or performance of the website or any of the content. While we try to ensure that all content provided by MVE is correct at the time of publication no responsibility is accepted by or on behalf of MVE for any errors, omissions or inaccurate content on the website.

17. Nothing in these terms limits or excludes MVE's liability for death or personal injury caused by its proven negligence. Subject to the previous sentence, MVE and/or AMM shall not be liable for any of the following losses or damage (whether such damage or losses were foreseen, foreseeable, known or otherwise): (a) loss of data; (b) loss of revenue or anticipated profits; (c) loss of business; (d) loss of opportunity; (e) loss of goodwill or injury to reputation; (f) losses suffered by third parties; or (g) any indirect, consequential, special or exemplary damages arising from the use of myvalidemails.com regardless of the form of action.

18. The MVE and AMM do not warrant that functions available on myvalidemails.com will be uninterrupted or error free, that defects will be corrected, or that myvalidemails.com or the server that makes it available are free of viruses or bugs. You acknowledge that it is your responsibility to implement sufficient procedures and virus checks (including anti-virus and other security checks) to satisfy your particular requirements for the accuracy of data input and output.

General

19. If any of these terms are determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these terms are intended to be effective, then to the extent and within the jurisdiction in which that term is illegal, invalid or unenforceable, it shall be severed and deleted from these terms and the remaining terms shall survive and continue to be binding and enforceable.

20. The failure or delay of MVE to exercise or enforce any right in these terms does not waive MVE's right to enforce that right.

21. These terms shall be governed by and interpreted in accordance with the laws of England and Wales which shall have exclusive jurisdiction over any disputes.
